Terms & Conditions

Last updated: 21 October 2026

These Terms govern use of the Island Retail Point of Service (POS) System provided by SkillVantage Enterprise. They are governed by the laws of Jamaica. By creating an account, signing in, or using Island Retail, you agree to these Terms and to our Privacy Policy.

1. About these Terms

Island Retail is provided by SkillVantage Enterprise ("SkillVantage", "we", "us"). These Terms apply to the business that subscribes to Island Retail ("the Business") and to every person the Business authorises to use it ("Users"). The Business is responsible for its Users' compliance with these Terms. A signed service agreement or order form between SkillVantage and the Business takes priority over these Terms if they conflict.

Records and agreements made electronically through Island Retail have legal effect in accordance with the Electronic Transactions Act, 2006.

2. The service

Island Retail provides point of service, kitchen and order management, product catalogues, inventory, timekeeping, accounting, and reporting tools for businesses such as cafes, restaurants, markets, and haberdasheries. Features may differ by store type and subscription. We may improve, change, or retire features. We will give reasonable notice before removing a feature the Business relies on.

3. Accounts, roles, and security

4. Acceptable use

You must not:

5. Business data

The Business owns the data it and its Users enter into Island Retail, including sales, products, stock, customer, employee, and accounting records ("Business Data"). The Business gives SkillVantage permission to process Business Data only to provide, secure, support, and improve the service, and as described in the Privacy Policy.

For personal data within Business Data, the Business is the data controller and SkillVantage is its data processor under the Data Protection Act, 2020. The Business is responsible for having a lawful basis to collect that data and for giving customers and employees appropriate privacy notices.

The Business may export its Business Data at any time while its subscription is active, and for 30 days after it ends, after which we may delete it, unless the law requires us to keep it.

6. Card payments

7. Tax, receipts, and records

Island Retail provides tools to configure General Consumption Tax (GCT) rates and item classifications (standard-rated, zero-rated, and exempt), produce receipts and tax invoices, and report sales and tax by period. However:

Prices displayed to customers must comply with the Consumer Protection Act, including clear disclosure of prices and any applicable taxes.

8. Timekeeping and payroll

Island Retail records clock-ins, breaks, register sessions, and manager-approved timesheets. Where payroll features are used, the Business is responsible for pay rates, overtime, holiday and leave entitlements, statutory deductions and contributions (PAYE, NIS, NHT, Education Tax, and HEART/NSTA Trust), filings, and payments to employees, in line with Jamaican employment law. Payroll outputs should be reviewed by the Business before approval. Island Retail does not send money to employees or government bodies unless a supported, separately agreed integration is enabled.

9. Fees and billing

Subscription, implementation, hardware, training, and support fees are set out in the Business's order form or service agreement. Unless stated otherwise, fees are quoted in Jamaican dollars (JMD), exclusive of GCT, which is added where applicable. Invoices are payable within the stated terms. We may suspend the service for invoices more than 30 days overdue after giving written notice. Payment processing fees charged by banks or payment providers are separate and payable by the Business to those providers.

10. Availability and offline use

We aim to keep Island Retail available at all times but do not guarantee uninterrupted service. Planned maintenance will be scheduled outside normal trading hours where possible. Island Retail can record sales locally during an internet outage and synchronise them once the connection returns. Reports and remote dashboards show when each store last synchronised and may not reflect sales made during an outage until then. The Business is responsible for its internet connection, power backup, and in-store hardware.

11. Ask Island Retail assistant

The assistant explains Business Data and links to the supporting records. Its answers are for information only and may contain errors. They are not financial, tax, legal, or employment advice. Purchases, stock adjustments, payroll, payments, and published marketing always require approval by an authorised User.

12. Intellectual property

Island Retail, including its software, design, and documentation, is owned by SkillVantage or its licensors and is protected by the Copyright Act and other laws of Jamaica. The Business receives a non-exclusive, non-transferable right to use Island Retail during its subscription. The Business keeps all rights in its own branding, product photographs, and content uploaded to Island Retail, and permits us to display them within the service for the Business.

13. Suspension and termination

14. Warranties and liability

We will provide Island Retail with reasonable skill and care. Apart from that, and to the extent the law allows, Island Retail is provided "as is" without other warranties.

To the extent permitted by law, SkillVantage is not liable for indirect or consequential loss, lost profits, or loss caused by inaccurate data entry, tax misconfiguration, payment provider outages, internet or power failures, or unauthorised use of a User's account. Our total liability in any 12-month period is limited to the fees paid by the Business for Island Retail in that period.

Nothing in these Terms limits liability that cannot be limited under Jamaican law, or any rights a consumer has under the Consumer Protection Act.

15. Governing law and disputes

These Terms are governed by the laws of Jamaica. The parties will first try to resolve any dispute in good faith through discussion between senior representatives. If it is not resolved within 30 days, either party may refer it to mediation in Jamaica or bring proceedings in the courts of Jamaica, which have exclusive jurisdiction.
